What Type of Sentence Could I Be Facing With My First DWI/DUI?

North Carolina takes DWI/DUI offenses very seriously and in certain circumstances even a first time offender can find themselves serving an active sentence.  The sentences given in DWI/DUI are very fact specific, with a judge looking at statutorily proscribed grossly aggravating, aggravating, and mitigating factors.  In general, the best case scenario for a first time offender will be a choice between 24 hours in jail or 24 hours of community service, a fine up to $200 plus court costs, a suspended license for a year but with the possibility of obtaining a limited driving privilege for work and school, and probation with a suspended jail sentence that can be imposed if there are any violations of the conditions of probation.  In the worst-case scenario, a first time offender can receive a sentence as severe as 2 years in jail and a $4,000 fine.  For a more detailed outline of DWI/DUI sentencing in North Carolina, please refer to this page in our site.
