Expungements

Expungements

Being charged with a criminal offense can have a detrimental effect on your life even if the charges are ultimately dismissed. Being arrested, charged with a crime, or a conviction are all a matter of public record that will turn up on any routine background check. This blemish on your record could limit your ability to find employment, your educational opportunities, ability to borrow money, and even your ability to find housing.

At the Law Offices of Banks Huntley, we help people who have been charged with a crime to seal their criminal records through a legal process known as an expungement. Once you are granted an expungement, the criminal arrest, charge, or conviction will no longer appear on a routine criminal record check. With an expungement you may legally deny that you were arrested, charged, or convicted of the expunged offense. Criminal defense attorney Banks Huntley has experience with all the different types of expungements available in North Carolina and will personally handle your expungement. Do I Qualify for an Expungement?

Expungements are not available for everyone and it is often times dependent on the crime committed, age of the person that committed the crime, and the disposition of the case. You may be able to expunge your record in the following circumstances:

• If you were convicted of a misdemeanor or some felony offenses before the age of 18
• If you were found not guilty or received a dismissal of the charges against you
• Under N.C.G.S. 90-96, first-time misdemeanor drug possession and paraphernalia charges may be expunged for people under age 21
• You were convicted of misdemeanor possession of alcohol before the age of 21
