Pre-Trial Limited Driving Privilege

A DWI/DUI will result in an automatic 30-day driver’s license suspension.  After the 10th day of this 30-day suspension, you are eligible to get a limited driving privilege.  A limited driving privilege allows you to drive from the hours of 6 a.m. to 8 p.m. Monday through Friday.  In certain instances a judge may approve you for additional hours to drive and weekend driving privileges.  To be eligible for a pre-trial limited driving privilege you must meet the following requirements:

Post-Conviction Limited Driving Privilege

If you are convicted of DWI/DUI your license will automatically be suspended for at least 12 months.  If convicted you are immediately eligible to apply to the court for a limited driving privilege if you were sentenced as a level 3-5.  To receive these driving privileges you must meet the same eligibility requirements that are found above for the pre-trial limited driving privilege.  If granted, these driving privileges will be in effect for the entire 12-month suspension period.

If you had a blood alcohol content (BAC) of .15 or higher, after a conviction of DWI/DUI you are eligible for a limited driving privilege 45 days after the date of conviction.  To be eligible for this limited driving privilege you must meet all the requirements listed above and provide proof of installation of an ignition interlock device.  If you are sentenced as an aggravated level 1, level 1, or level 2, you will not be permitted to petition the court for a limited driving privilege.
